The case went through various legal proceedings, and at one point, the European Court of Justice ruled that Nestlé had not proven the distinctiveness of the shape. The dispute continued for several years, with the final outcome involving a setback for Nestlé's attempt to secure a trademark for the Kit Kat shape.
